Porque Bignone y los tres milicos que lo acompañaron en lo que fue la cuarta Junta de la dictadura, no fueron alcanzados por el decreto de juzgamiento dictado por Alfonsín. Eran el Teniente General Cristino Nicolaides en representación del Ejército, el almirante Rubén Oscar Franco por la Marina y el brigadier general Augusto Jorge Hughes por la Fuerza Aérea. Se entiende por qué: Bignone y la multipartidaria habían pactado las condiciones en las que la dictadura saldría del poder, y ese arreglo incluía cláusulas de impunidad.
